The notion of developing business links between Australia and Asia is an attractive one for many organisations, yet the right legal advice is essential to ensure that your interests are well protected.

Hunt & Hunt has developed the structure and skills to provide such assistance to both Australian and Asian clients who may be pursuing trade or investment in these markets, on a joint venture or independent basis.

Through our offices in Shanghai and Auckland, and our membership of the global association, Interlaw, we have the Asia region well covered.

Our Asia division focuses primarily on working with clients with interests in China and India. This division is comprised of lawyers and other commercial experts who have a clear understanding of the needs of Asian business and who assist clients in the conduct of their business operations both within these countries and in trade with Australia.

Importantly, and in addition to simply providing legal advice, members of our Asia team provide government and commercial introductory services to clients exploring Asia/Australia trade and business opportunities. Some of our team members speak many of the Chinese and Indian language dialects, thus facilitating communications during business exchanges and enhancing the firm’s translation and interpretation services.

The firm offers expertise in a range of legal and advisory services to clients operating in the Asia Pacific region.  These include:

  • advising on international treaties, conventions and practice concerning international trade and commerce
  • market research and feasibility studies, including the development of market entry strategies
  • advising on the commercial and legal aspects of doing business in Asia
  • advising on the selection and establishment of business partners or trading entities in Australia (including companies, joint ventures and so forth) and in Asia (including equity and cooperative joint ventures, wholly foreign owned enterprises and representative offices)
  • drafting, reviewing and negotiating commercial contracts and other documents in English, Chinese and Indian, as well as providing English and Asian language translation services in-house or by referral to external translators
  • advising on the protection and licensing of intellectual property in Australia and overseas. This includes drafting, reviewing and negotiating technology licensing or transfer agreements

  • advising on commercial disputes involving litigation or arbitration

India

In Australia, we have well qualified team of lawyers and other professionals which serves the needs of clients in India and Australia. The team provides governmental, commercial and introductory services to Australian and Indian entities interested in exploring the rapidly growing area of Australia-India trade and projects. Our networks in India include various trade and commercial organisations. In Australia we are members of bodies such as the Australia-India Business Council and the Australia India Chamber of Commerce.

Recent examples of work undertaken by our India Division include:

  • Consulate General of India: Hunt & Hunt is legal panel advisor to the Office of the Consulate General of India in Sydney.
  • State Bank of India: We advise the Bank on human resources and stamp duty issues. We also assist them in identifying appropriate clients for extending their base in the field of merchant banking operations in Australia when they are granted a licence from APRA or the Reserve Bank of Australia.
  • Griffith University: Hunt & Hunt facilitated a visit to University of Law in Hyderabad, NALSAR, for a representation from Griffith University in Australia. The visit was aimed at promoting law education in post-graduate research and other issues. A Memorandum of Understanding between the two universities has been signed.
