Area of Practice:

Georgie primarily handles Insurance and commercial claims and coverage disputes, particularly those involving:

  • public and products liability;
  • breach of contract;
  • trade practices;
  • occupational health and safety;
  • corporations law;
  • dispute resolution / mediation;
  • freedom of information;
  • workers' compensation; and
  • general tort-based litigation.

Georgie also advises on:

  • interpreting and drafting policies of insurance;
  • indemnity provisions in contracts;
  • claims assessment;
  • statutory and compliance issues;
  • corporate insurance;
  • risk review; and
  • management of commercial projects for various corporate entities.

Experience:  

Georgie primarily acts for national and multinational insurers and corporations. Some recent experience includes:

  • a $20 million recovery proceeding for Vero Global & Risk Managed and PaperlinX Ltd for business interruption and material damage arising from a defective papermaking machine at Paperlinx Ltd’s Maryvale paper mill. This proceeded to a full 4 week hearing before the Supreme Court in late 2006. Judgment was delivered in late 2007 and resulted in a complete victory for Vero Global & Risk Managed and PaperlinX Ltd, with a $20 million award of damages in the clients' favour and costs awarded on an indemnity basis against the unsuccessful defendant;
  • defending an application for special leave to appeal to the High Court of Australia for the Moyne Shire Council, which application the High Court of Australia ultimately refused;
  • a $15 million claim for Vero Global & Risk Managed concerning business interruption and material damage arising from a fire at Johnson Matthey’s gold refinery in Thomastown;
  • defending 6 concurrent Supreme Court proceedings for a Lloyds' of London Syndicate for economic loss in excess of $20 million arising from the collapse of the Corio Overpass in Geelong. These proceedings also involved a claim for damages arising from the death of a worker in the incident and 3 further claims for damages by injured workers;
  • a landmark decision for Alcoa Limited before the Supreme Court in December 2006 which altered the entitlement of the Victorian WorkCover Authority to recover certain payments made to injured workers against self-insurers;
  • defending 3 'test case' occupational asthma claims and a 'test case' claim relating to workplace-contracted carcinoma for Alcoa Limited before the Supreme Court;
  • defending a claim for breach of various lease covenants and Occupational Health & Safety Regulations arising from asbestos contamination of commercial premises for Suncorp Metway Insurance Limited which ran to a full hearing before the Supreme Court in February 2007 and is currently on appeal;
  • a product recall claim for Vero Global & Risk Managed involving the recall of Arnott’s Snackfoods' potato chips due to undeclared allergens in the product; and
  • advising executive management on legislative changes to workers' compensation law and on the general management of workers' compensation claims disputes, workplace injury management and rehabilitation.
