Experience:  

Martin has been working in employment law since 1995. Prior to joining our firm he worked as a Special Counsel at Leitch Hasson Dent Solicitors.

In the Federal jurisdiction Martin provides legal advice and services regarding the Workplace Relations Act, NAPSAs, Awards and Workplace Agreements, Contractual Arrangements, Termination of Employment, Discrimination and harassment.

He has represented employers before the Australian Industrial Relations Commission defending applications regarding unfair dismissals/unlawful dismissals and prior to Work Choices, regarding Industrial Agreements representing employers before the Human Rights and Equal Opportunity Commission.

In the NSW State jurisdiction he provides legal advice and services regarding the Industrial Relations Act, Awards, Contract Determinations and NAPSAs, Union Common Law Deeds of Agreements, (including negotiating with TWU, Civil Penalty Prosecutions, (including negotiating with TWU). Contractual Arrangements, including agreements relating to employment, contract carriers and independent contractors, Termination of Employment and Redundancy, Discrimination and Harassment; effects of government policy (e.g. Procurement); employment policies (e.g. internet use and drugs & alcohol); Confidentiality Agreements and Restrictive Covenants; Occupational Health and Safety compliance issues, Unfair Contracts and Equal Opportunity.

He has represented employers in Industrial Relation Commission of NSW defending:

  • prosecutions for civil penalty brought by Transport Workers Union for award breaches,
  • prosecutions brought by WorkCover Authority for breaches of Occupational Health and Safety legislation
  • unfair dismissals applications
  • disputes arising from Union applications including Mutual Responsibility for Road Safety Award and Contract Determination, Transport Industry Redundancy State Contract Determination) and Cash in Transit OHS dispute

He regularly represents employers before the Anti-Discrimination Board.

Martin also provides legal services to Employment Law Unit, Legal Services, NSW Police Force in respect of disciplinary, reviewable and non-reviewable actions, including drafting relevant notices, orders and deeds of release, defending disputes brought in Industrial Relation Commission of NSW in respect of Applications seeking review of decisions (reviewable actions and unfair dismissal) and industrial disputes.

His clients include employer associations and members in the road transport, waste, recycling, construction, retail and farming industries.

Completing his full range of employment law services, Martin has extensive experience advising and representing employers and scheme agents in litigation arising from all manner of workplace injuries.

He has been engaged by the WorkCover Authority as an in‑house consultant in the common law division, has worked as an appeals management officer in the Workers Compensation Commission and completed a temporary engagement with the WorkCover Authority in their uninsured liability scheme section.

Martin also provides seminars and training sessions.
