Mark Byers

Providing easy to understand, detailed advice that takes into account key issues and timing sensitivities is the driving force behind Mark’s success in commercial property law.

Being responsive and practical, Mark’s assistance is regularly sought for a variety of matters including the sale and purchase of commercial and industrial land and associated due diligence, as well as retail, commercial and industrial leasing, acting for lessors and lessees.

General commercial and contractual issues are another specialty of Mark’s, drafting and reviewing a wide range of general commercial contracts, such as supply agreements.

A quick overview of how Mark uses his expertise to the benefit of his clients is shown below:

  • North Sydney Council: advising on all aspects of property and planning work, together with acquisitions under the Land Acquisitions (Just Terms Compensation) Act 1991. For instance, Mark advises on leases to community organisations (pools, tennis and bowling clubs, scout halls, community and child care centres, indigenous groups) and on licensing of Council property for uses such as car parks, office and commercial space for short-term use, and parts of roads subject to compulsory acquisitions being gazetted.

  • Defence Housing Australia: advising on acquisitions and sale/lease back of residential properties in NSW. In this role, Mark supervises a high volume of conveyancing matters and provides ancillary advice and legal support on its residential developments.
  • O’Brien Glass Industries Limited and Stegbar Pty Limited: acting as general property counsel, assisting with a range of issues including debtor management, enforcing rights under leases, licenses, easements and other property matters.
  • Affordable Community Housing Ltd: advising on the National Rental Affordability Scheme Act 2008 and the New South Wales Affordable Housing Scheme. Mark drafts property management agreements for both schemes which protect his client's position as one of the largest providers of affordable housing in New South Wales.
