Experience

Since 1995 Martin has been working in Employment law, Industrial Relations and associated areas.

His clients include employer associations, domestic and international companies in the road transport, health care, scientific research, tertiary education, manufacturing, waste & recycling, motor trade, banking, construction, retail and labour hire industries.

Martin has extensive experience drafting, reviewing and advising employers in regard to:

  • employment agreements and sub-contracting engagements.
  • non-compete, intellectual property and confidential information clauses.
  • internal employment policies.
  • recruitment and pre-employment processes.
  • restructuring strategies including transfer of business and redundancy.

He also provides employers with solutions regarding:

  • compliance with the Fair Work Act, modern and pre-modern awards
  • counselling and performance management
  • unfair and unlawful termination of employment
  • the engagement of contractors and casual employees,

Martin appears before workplace tribunals including Australian Human Rights Commission, Federal Court, Fair Work Australia, Federal Magistrates Court, Local Court, District Court, Supreme Court, and NSW Industrial Relations Commission in matters including:

  • unfair dismissals/unlawful dismissals/adverse actions
  • discrimination/harassment
  • breach of contract
  • award modernisation
  • prosecutions for award and industrial instrument breaches
  • prosecutions for breaches of Occupational Health and Safety legislation

He also has extensive experience advising and representing employers and scheme agents in litigation arising from workplace injuries.

He has been engaged by the WorkCover Authority as an in-house consultant in the common law division, has worked as an appeals management officer in the Workers Compensation Commission and completed a temporary engagement with the WorkCover Authority in their uninsured liability scheme section.

Martin also presents seminars and training sessions in-house, on site and on behalf of recognised training organisations.
