Claire is a highly experienced insurance practitioner and litigator with extensive experience across all lines of insurance.
Claire represents insurers (including captive insurers and self-insurers), as well as brokers, claims managers and private and government policyholder clients. Claire is uniquely placed in the market, having extensive experience in coverage disputes, litigated claims and insurance and risk advisory matters, for both insurers and policyholders.
She is highly regarded for her sound and pragmatic legal advice and her ability to proactively anticipate what is required to achieve the best possible outcomes for her clients.
A selection of Claire’s significant experience includes:
- Advising both insurers and policyholders regarding coverage issues and assessing the insurance policy response.
- Defending public liability claims in all jurisdictions against a range of clients, including local councils, infrastructure providers and property owners.
- Successfully litigating insurance indemnity disputes for policyholder clients, particularly disputes regarding Industrial Special Risks, material damage and business interruption policies.
- Representing self-insurers in workers’ compensation claims by their employees.
- Reviewing and advising on multi-layered insurance programs.
- Acting for captive insurers in subrogated recovery actions, as well as managing a high volume of recoveries for corporate clients.
- Conducting efficacy reviews of insurance policies for policyholder clients, including many large listed companies, and drafting amendments to the insurance contracts.
- Successfully defending claims against various insured professionals, particularly in the building and construction industries.
- Advising regarding Directors’ and Officers’ (D&O) insurance generally, including the interaction with Directors’ Deeds of Indemnity, the legislative provisions which prohibit indemnity in certain circumstances and how best to structure a D&O insurance program.
- Managing a high volume of recoveries.
