Personal Experience

Starting her career as a Graduate with Hunt & Hunt in 2002, Anthea now practices in general and commercial litigation, with a focus on estate litigation.

Estate litigation

Anthea’s experience includes working on equity claims in the Supreme Court involving disputes regarding the validity of wills, including multiple cases defending and questioning testators’ capacity to make a will. Anthea focuses on and often achieves early settlement of matters.

When matters do come before the court, she has achieved successful outcomes. Anthea has also worked on many Family Provision claims under the Succession Act and has acted for executors, plaintiffs and beneficiaries that include family members, charities and/or other dependent parties.

Anthea has worked on a number of estate matters including:

  • Informal documents – does the document constitute a valid will and/or codicil?
  • Family Provision claims involving notional estate
  • Construction suits – what does the clause of the will actually mean?
  • Probate disputes – calling executors to account and determining whether the executor is properly distributing the estate
  • Original will being lost – having it admitted to probate
  • Matters before the Superannuation Tribunal

General commercial litigation

Anthea has experiencing in assisting with:

  • Building disputes
  • Strata plan disputes
  • Business litigation and commercial disputes for medium sized businesses
  • Debt recovery matters for a number of educational institutions
  • Settlement of a successful debt recovery matter for one of Australia’s largest intermediary based general insurers
  • Settlement of commercial disputes through mediations and settlement conferences, with a number resulting in agreements between parties
